Welcome to BailBuzz ("we", "our", "us"). These Terms and Conditions ("Terms") govern your access to and use of the BailBuzz platform, including our website, mobile applications, APIs, software, and services (collectively, the “Service”). By accessing or using BailBuzz, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility

You must be at least 18 years old and legally able to form a binding contract to use our Service. By using BailBuzz, you represent and warrant that you meet these requirements.

2. Service Description

BailBuzz provides real-time monitoring of publicly available inmate data from various county and sheriff websites. The Service notifies bail bond companies via SMS, email, or in-app notifications when new arrest data becomes publicly available, including charges, bond amounts, and booking details.

Important Notice:
We can only provide services where data is made available via publicly accessible inmate and prison systems. BailBuzz does not extract or provide any restricted or non-public information.

3. Account Registration

To access our Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information.

  • Maintain the security of your account credentials.

  • Notify us immediately of any unauthorized use of your account.

You are responsible for all activities that occur under your account.

4. License and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your internal business purposes. You agree not to:

  • Use the Service for any unlawful purpose.

  • Copy, scrape, or redistribute data in a way that competes with or undermines BailBuzz.

  • Reverse engineer, disassemble, or attempt to extract source code from any part of the platform.

5. Data Sources and Accuracy

Our Service relies on data published by third-party governmental agencies. While we strive to provide fast and accurate alerts, we make no guarantees regarding:

  • The availability or completeness of data.

  • The accuracy or timeliness of notifications.

You acknowledge that inaccuracies, delays, or omissions may occur, and BailBuzz is not responsible for any actions taken based on the provided data.

6. User Responsibilities

You are solely responsible for:

  • Ensuring lawful and appropriate use of data provided through our Service.

  • Complying with all applicable local, state, and federal regulations.

  • Training and supervising any of your employees or agents who access the Service.

7. Payment and Billing

Access to some features of BailBuzz may require payment. By subscribing or using paid features, you agree to:

  • Pay all applicable fees.

  • Allow us to charge your payment method for recurring or usage-based charges.

  • Understand that payments are non-refundable unless explicitly stated otherwise.

Failure to pay may result in suspension or termination of access.

8. Confidentiality and Privacy

All communications and data between you and BailBuzz are treated as confidential. We do not sell your data. Our handling of personal information is governed by our Privacy Policy, which you agree to by using our Services.

9. Service Interruptions and Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. You acknowledge that interruptions may occur and that BailBuzz shall not be liable for any loss resulting from such disruptions.

10. Termination

We reserve the right to terminate or suspend your access to the Service at any time, for any reason, including violation of these Terms. Upon termination, you must cease all use of the Service, and any outstanding fees become immediately due.

You may also terminate your account at any time through your user dashboard or by contacting us.

11. Intellectual Property

All content, software, designs, trademarks, and branding are the property of BailBuzz or its licensors. You may not use them without express written permission.

12. Limitation of Liability

To the fullest extent permitted by law, BailBuzz shall not be liable for:

  • Any indirect, incidental, special, or consequential damages.

  • Business losses, including lost profits or data.

  • Damages resulting from reliance on inaccurate or delayed inmate data.

Our total liability under these Terms shall not exceed the amount you paid us in the three months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless BailBuzz and its affiliates, directors, officers, and employees from any claims or liabilities arising from:

  • Your use of the Service.

  • Your violation of these Terms.

  • Any misuse of inmate data sourced through the platform.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Pennsylvania, specifically the County of Butler. Any legal action or proceeding shall be brought in the appropriate courts located in Butler County, PA.

15. Changes to Terms

We may update these Terms from time to time. If we make significant changes, we will notify you via email or through the platform. Continued use of the Service after the effective date of any change constitutes acceptance of the revised Terms.
